GYST's Privacy Policy

Introduction

Our website is subject to Swiss data protection law (DSG) and the European General Data Protection Regulation (EU-GDPR). We take the protection of the data of the users ("you") seriously and are committed to protecting the information that you provide to us in connection with the use of our website. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration. We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is not possible.

This Privacy Policy explains our practices regarding the collection, use, and disclosure of your information through the use of our digital assets ("Services") when you access them through your devices.

Please read the Privacy Policy carefully and ensure you fully understand how we handle your information before using our Services. If you have read this Policy, fully understand it, and do not agree with our practices, you must stop using our Services. By using our services, you accept the terms of this privacy policy. Continued use of the Services constitutes your acceptance of this Privacy Policy and any changes thereto.

In this privacy policy you will learn:

  • How we collect data

  • What data we collect

  • Why we collect this data

  • Who we share the data with

  • Where the data is stored

  • How long the data is retained

  • How we protect the data

  • Update or change the privacy policy

How do we collect data?

Below are the main methods we use to collect data:

  • We collect data when you use our services. So when you visit our website and use services, we may collect, record and store usage, sessions and related information.

  • We collect data that you make available to us yourself, for example if you contact us via a form (e.g. order form or contact form).

What data do we collect?

Below is an overview of the information we may collect. On the one hand, your data is collected when you communicate it to us yourself, for example using a form provided by us. Other data is automatically recorded by our IT system when you visit the website.

  • Unidentified and unidentifiable information collected through the use of our Services ("Non-Personally Identifiable Information") does not provide any indication of who collected it. Non-personal data that we collect consists mainly of technical and aggregated usage information (e.g. Internet browser, operating system or time of page view). This data is collected automatically as soon as you visit our website.

  • Individually identifiable information, i.e. all that by which you can be identified or could be identified with reasonable effort ("Personal Data"), is information that is requested from time to time, such as first name, last name, company, e-mail address , IP address and more. If we combine personal information with non-personal information, we treat it as personal information for as long as it is combined.

Why do we collect this data?

We may use your data for the following purposes:

  • to provide and operate our Services;

  • to develop, customize and improve our Services;

  • to respond to your feedback, requests and requests and to offer assistance;

  • to analyze request and usage patterns;

  • for other internal, statistical and research purposes;

  • to improve our data security and fraud prevention capabilities;

  • to investigate violations and enforce our terms and policies and to comply with applicable law, regulation or governmental request;

  • to send you updates, news, promotional materials and other information related to our Services. With promotional emails, you can decide for yourself whether you want to continue receiving them. If not, just click the unsubscribe link in those emails.

Who do we share this information with?

Many data processing operations are only possible with your express consent. You can revoke consent that you have already given at any time. An informal message by e-mail to the address below is sufficient. The legality of the data processing that took place up until the revocation remains unaffected by the revocation. We may share your information with our service providers in order to operate our services (e.g. storing information through third party hosting services, providing technical support, etc.).

We may also disclose your information in the following circumstances:

  • to investigate, detect, prevent or address illegal activity or other wrongdoing;

  • to establish or exercise our rights of defense;

  • to protect our rights, property or personal safety, or the safety of our users or the public;

  • in the event of a change of control of us or any of our affiliated companies (by way of a merger, acquisition or purchase of (substantially) all assets, etc.);

  • to collect, hold and/or manage your data using authorized third party service providers (e.g. cloud service providers) as appropriate for business purposes;

  • to work with third parties to improve your user experience. To avoid misunderstandings, we would like to point out that we can transfer or pass on non-personal data to third parties or use them in any other way at our own discretion.

Cookies and Similar Technologies

When you visit our website, your surfing behavior can be statistically evaluated. This is mainly done with cookies and so-called analysis programs. Your surfing behavior is analyzed anonymously; surfing behavior cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. Most of the cookies we use are so-called “session cookies”. They are automatically deleted after your visit. Other cookies remain stored on your end device until you delete them. These cookies enable us to recognize your browser on your next visit. You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, accept cookies for certain cases or generally exclude them and activate the automatic deletion of cookies when you close the browser. If cookies are deactivated, the functionality of this website may be restricted. Cookies that are required to carry out the electronic communication process or to provide certain functions you want (e.g. forms) are stored on the basis of Article 6 (1) (f) GDPR. The website operator has a legitimate interest in the storage of cookies for the technically error-free and optimized provision of its services. When you visit or access our Services, we authorize third parties to use web beacons, cookies, pixel tags, scripts, and other technologies and analytics services ("Tracking Technologies"). These Tracking Technologies may enable third parties to collect your information automatically in order to improve the navigation experience on our digital assets, to optimize their performance and to ensure a customized user experience, as well as for security and fraud prevention purposes. To learn more about it, please read ourCookie Policy.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits. These are:

  • Referrer URL

  • Host name of the accessing computer

  • Time of server request

  • IP address (encrypted)

The basis for data processing is Art. 6 Paragraph 1 lit. f GDPR, which permits the processing of data to fulfill a contract or pre-contractual measures.

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". These are text files that are stored on your computer and that enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. Google Analytics cookies are stored on the basis of Article 6 (1) (f) GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising.

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our website. The provider is Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google"). With reCAPTCHA it should be checked whether the data entry on our website (e.g. in a contact form) is done by a human or by an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, length of stay on the website or mouse movements made by you). The data collected during the analysis is forwarded to Google. The reCAPTCHA analyzes run completely in the background. You will not be informed that an analysis is taking place. Data processing takes place on the basis of Art. 6 Para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and from SPAM. For more information about Google reCAPTCHA, see Google's privacy policy.

Double opt-in and logging

The form is submitted in a so-called double opt-in procedure. This means that you will receive an e-mail after submitting it, in which you will be asked to confirm your form submission. This confirmation is necessary so that no one can submit with someone else's email address. The submissions are logged in order to be able to prove the submission process according to the legal requirements. This includes storing the submission and confirmation times as well as the IP address. As a visitor to our website, you are responsible for the security of your data, your e-mail account and the related authentication when submitting the form. You access our website using transport encryption (SSL/TLS).

LinkedIn
Within our online offer, we use the marketing services of the LinkedIn social network from LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland ("LinkedIn").

These use cookies, i.e. text files that are stored on your computer. This enables us to analyze your use of the website. For example, we can measure the success of our advertising and show users products that they were previously interested in.
For example, information about the operating system, the browser, the previously visited website (referrer URL), the websites visited, the offers clicked on and the date and time of your visit to our website are collected.

The information generated by the cookie about your use of this website is transmitted in pseudonymous form to a LinkedIn server in the USA and stored there. LinkedIn therefore does not store the name or e-mail address of the respective user. Rather, the aforementioned data is only assigned to the person for whom the cookie was created. This does not apply if the user has allowed LinkedIn processing without pseudonymization or has a LinkedIn account.

You can refuse the use of cookies by setting your browser accordingly, but please note that you may then not be able to use all the functions of this website. You can also object to the use of your data directly on LinkedIn: https://www.linkedin.com/psettings/guest-controls/retargeting-opt-out.

We use LinkedIn Analytics to analyze and regularly improve the use of our website. The statistics obtained enable us to improve our offer and make it more interesting for you as a user. All LinkedIn companies have adopted Standard Contractual Clauses to ensure that traffic to the United States and Singapore required for the development, implementation, and maintenance of the Services is done in a lawful manner. If we ask users for their consent, the legal basis for processing is Art. 6 (1) lit. a GDPR. Otherwise, the legal basis for the use of LinkedIn Analytics is Art. 6 Para. 1 S. 1 lit. f GDPR.

Third Party Information: LinkedIn Ireland Unlimited Company Wilton Place, Dublin 2 Ireland; User Agreement and Privacy Policy.

Data transfer to the USA
Our website includes tools from companies based in the USA. If these tools are active, your personal data may be transferred to the US servers of the respective companies.

We would like to point out that the USA is not a safe third country within the meaning of EU data protection law. US companies are obliged to release personal data to security authorities without you as the person concerned being able to take legal action against it.

It can therefore not be ruled out that US authorities (e.g. secret services) will process, evaluate and permanently store your data on US servers for monitoring purposes. We have no influence on these processing operations.
